Ohio's Election Stolen Again? State May Face 600K Voter Purge in Coming Weeks

Voting rights attorneys say hundreds of thousands of voters could be purged from voter rolls.

Editor's note: In 2004, election integrity activists challenged the results of Ohio's presidential election before the Ohio Supreme Court, and convinced Rep. Stephanie Tubbs-Jones (D-OH) and Sen. Barbara Boxer (D-CA) to challenge the state's Electoral College vote before a joint session of Congress. The reaction by Ohio's then Republican-controlled Legislature was to enact a series of election reforms that punished likely Democratic voters. Some of the laws adopted were later thrown out in court, such as penalizing voter registration drives. But others, including a technical process to require certain voters to prove their registrations are valid on Election Day -- or lose their right to vote, remain in effect. Two of the nation's top voting rights groups, Advancement Project and Project Vote, this week reported 600,000 Ohio voters could be effected. This article is a combination of the releases both groups issued this week. George W. Columbus, Ohio August 13, 2008 -- Nearly 600,000 eligible Ohio voters may be dropped from the voter rolls if Secretary of State Jennifer Brunner doesn't act to protect these voters, according to findings based on publicly available information discovered by Advancement Project and Project Vote.
These voters -- disproportionately voters of color and young voters -- are subject to being removed from Ohio's voter registration rolls without notice or a hearing because of the state's vague regulations on vote caging, a process that enables representatives of one political party to challenge the voter registration credentials of voters at polling places on Election Day.

The Ohio counties with largest numbers of returned notices prior to March 2008 Presidential Primary are Cuyahoga, Franklin, Hamilton, Lucas and Summit, where Cleveland, Columbus, Cincinnati and Toledo are located.

The mechanism of caging or challenging voters dates back to legislation passed soon after the 2004 presidential election.

In 2005, Ohio's General Assembly introduced legislation, House Bill 3 (H.B.3) that overhauled Ohio's election system. H.B. 3, in part, requires voter information mailings and amends Ohio's challenge statute(s). In particular, it requires that 88 county boards of election mail all Ohio registered voters a non-forwardable notice 60 days before the election. Each board must compile into a list any notices that are returned as undeliverable. These lists, in turn, are available as public records to any individual or group seeking to use the list as a "caging list" to challenge voters.

The amended challenge law no longer requires the county boards to provide Ohio voters with notice that they are being removed from the voting rolls or a hearing for them to defend themselves of a challenge. Rather, the Ohio law permits the boards to review their own records and make a determination to the validity of the challenge.

This law was effective beginning 2006 and covers all primary, general, and special elections from 2006 through the November 2008 General Election. Advancement Project finds it extremely interesting, that this law "sunsets" effective January 1, 2009.

"A single returned piece of mail is not a reliable basis for challenging the right to vote," said Donita Judge, Ohio staff attorney, Advancement Project. "Mail may be returned for many reasons, including errors in the database from which the mailing is derived, errors in the mailing labels, failure to include an apartment number or poor matching criteria."

Advancement Project and Project Vote would like to see the Ohio Secretary of State, Jennifer Brunner, issue a directive prohibiting Ohio electors from challenging Ohio voters whose name appear on any returned mailings and/or any past, current or future caging list. This is the best remedy to ensure that all Ohio voters are treated in a uniform manner during the November 2008 election because it permits the county boards to send out information to Ohio voters and at the same time ensures that all voters are permitted to vote without the threat of being placed on a list that is subject to challenge for no other reason than a returned mailing.

"Partisan, challengers who have obtained a list of returned letters shouldn't be allowed to strip Ohio voters of their right to update their addresses" said Teresa James, attorney with Project Vote. The lack of notice to challenged voters under Ohio's 2006 challenge law allows this interference to take place quietly and behind closed doors. This violates the principles our nation was founded on. It is imperative that Secretary Brunner establish guidelines so that partisan challengers will not be permitted to lodge unfounded challenges that clog the election process, burden poll workers and disenfranchise eligible voters."

Ohio's current law is internally inconsistent. For instance, Ohio law permits voters who move from one precinct to another to change their address from 28-days prior to the election, up to and including Election Day. Yet, if a voter is challenged and removed from the rolls within 20 days of the Election and their registration is canceled, without notice, this cancels the effectiveness of a voter changing their address since there is no longer a registration on file. It also violates Ohio law and equal protection of the laws because this voter is not provided the same meaningful opportunity to update a valid registration up to and including Election Day as other Ohio voters.

The new election law also unfairly impacts black and Latino Americans and other voters of color. Advancement Project anticipates that significant number of voters of color will be included on the county generated caging lists because census data indicates that they move more frequently than whites. Furthermore, in light of the fact that college students change residences frequently, it is anticipated that large numbers of young voters will be included on the lists as well.

"Voter suppression and intimidation is driven by a desire to maintain the status quo, concluded Judge." "These acts are carried out in an effort to deprive certain Americans, especially those most marginalized, of a voice in our democracy. Election Day is the great equalizer -- it is the one day where if all was right in our democracy, it would not matter if a person is rich, poor, black, white, educated or not, we all would have the same amount of power."

Jay started making noise with the release of his single 'Dead Presidents', which garnered the attention of hip hop heads and fellow rappers like BIG. Biggy had just dropped a classic album with Ready To Die and was hands down the king of New York. After Dead presidents dropped, a few of Biggy's friends joked around and said that Jay-z may be better than him, where BIG replied "man, fuck that". There was a mutual respect as both emcee's were straight out of Brooklyn, and could both get busy on the mic. But their relationship was definitely fueled by competition as described by Jay-z and Ski on the 10 year anniversary of Reasonable Doubt edition of XXL. Little did we know that Jayz was actually taking shots at BIG on Brooklyns finest...

This rhyme right here is arguably the illest verse Jay ever spit...he talks about startin up in the drug game with one of his best friends he's known since childhood. Already the rhyme is riddled with clever symbolism with children fighting over lego pieces to street niggas fighting over street corners. But it gets more intense as he explains that the money had gotten in the way of their friendship and Jay-z was now trying to get the where abouts of his former friend through his baby's mother (he never learned how to use rubbers thus he has a baby mother).

The listener is painted a clear picture of Jay-z bribing this woman to give up the where abouts of her boyfriend...and as much as she doesn't want to, her greed for money is taking over (D'evils). At this point, Jayz takes this double meaning riddled verse to the next level with a very thought out line.

"So I kept feeding her money 'til her shit started to make sense"

On one hand the line is literal in the sense that the story shes making up doesn't add up until he starts giving her more money for her to come clean. On the other hand the line can be looked at as "So I kept feeding her money 'til her shit started to make CENTS". Up until now, im not really dropping any knowledge to the average head...but check out how Jay explained this line in XXL.

He described the human body and how it takes food through the digestive system...in the process the body takes the nutrients that it needs and excretes the rest through what we know as doo doo. So he goes on to say....the line above describes the metaphorical process of digesting a dollar bill. The body takes what it needs and excretes the few cents left over.

HOW FUCKIN DOPE IS THAT???

Keep listening on, and on the 3rd verse Jay drops a triple entendre, which until now, most listeners thought was just a double meaning.

"Throughout my junior high years it was all friendly
But now this higher learning got the Remy in me

Got me ready to lick off, mama forgive me"

On one hand once again we have the literal sense where Jay is talkin about how he was a good guy in Junior high til the D'evils (greed for money) got in him and had him wildin out. Metaphorically, he is comparing it to being drunk off remy...the greed has got him acting as if he was intoxicated. The line was dope enough, until i went out and rented a movie called 'higher learning'. The character known as 'Remy' was pretty much a pleasant guy all his fuckin life (from Junior highschool on, until he reached university...also known as higher learning). Remy then made skin head friends who showed him a new light and had him wildin out.

There my friends, we have a triple entendre.

One more for the beginners...

I hope this one isn't news to you. But none the less, a dope line regardless...Jay-z takes that street mentality, and that by-any-means necessary attitude disrespecting religion for the second time on the track (first one being "i never prayed to God i prayed to Gotti). He is implying that nothing could get between him and money. Taking 'Jehovah witness' and turning it into someone named Jehovah witnessing Jay-z commit a crime, but being too afraid to snitch.

If i was to explain all of Jay's clever rhymes it would take me forever (there's definitely going to have to be a 2nd part to this at least). A lot of times, his double meanings have to do with the Illuminati. I can't go into those yet, because first i need to convince you that im not a conspiracy theorist walkin around with aluminum foil on my ahead. I call it how i see it, and im very observant. This is kind of my claim to internet "fame"...i blogged about illuminati in hip hip wayyy before you could get any google results on the matter, and much before the exposing video's on youtube. Most of those are on some weirdo shit, so just stay tuned for me to drop the science on the matter.

COLUMBUS, Ohio (AP) — Residents of a mostly black neighborhood in rural Ohio were awarded nearly $11 million Thursday by a federal jury that found local authorities denied them public water service for decades out of racial discrimination.

Each of the 67 plaintiffs was awarded $15,000 to $300,000, depending on how long they had lived in the Coal Run neighborhood, about 5 miles east of Zanesville in Muskingum County in east-central Ohio.

The money covers both monetary losses and the residents' pain and suffering between 1956, when water lines were first laid in the area, and 2003, when Coal Run got public water.

The lawsuit was filed in 2003 after the Ohio Civil Rights Commission concluded the residents were victims of discrimination. The city, county and East Muskingum Water Authority all denied it and noted that many residents in the lightly populated county don't have public water.

Coal Run residents either paid to have wells dug, hauled water for cisterns or collected rain water so they could drink, cook and bathe.

"As a child, I thought it was normal because everyone done it in my neighborhood," said one of the plaintiffs, Cynthia Hale Hairston, 47. "But I realized as an adult it was wrong."

Colfax described the verdict as unique among civil rights cases nationally, both in the nature of the ruling and the size of the award.

The jury in U.S. District Court found that failing to provide water service to the residents violated state and federal civil rights laws. The lawsuit was not a class-action. Colfax said 25 to 30 families live in Coal Run now.

The water authority must pay 55 percent of the damages, while the county owes 25 percent and the city owes 20 percent, plaintiffs' attorney Reed Colfax said. The water authority no longer exists, and the county would be responsible for paying that share of the judgment.

Zanesville attorney Michael Valentine said in court that he intended to appeal but declined to comment further. The county commission also plans to appeal.

Attorney Mark Landes, who represented the county and water district, called the verdict disappointing. He said jurors were not allowed to hear defendants' testimony that neighborhood residents were offered water service years ago and refused it.

Colfax said he was unaware of any evidence that was excluded from the trial.

"This was a case that was started and fired by out-of-town lawyers who saw an opportunity for a cash settlement," Landes said.

The plaintiffs' attorneys will receive a separate amount to be decided later by a judge, Colfax said.

John Relman, a civil rights attorney based in Washington, D.C., who represented the residents, said the jury heard hours of testimony and saw hundreds of pages of documentation over the seven-week trial.

"This verdict vindicates that this (treatment) was because of their race," he said. "The jury agreed with that and issued a verdict based on a full airing of the facts."

Ohio Attorney General Nancy H. Rogers said she was pleased.

"This decision speaks firmly about the importance of treating citizens with equal respect, regardless of race," she said in a statement.

Plaintiff Frederick Martin said the long wait was worth it.

He and his nine siblings shared two tubs of water between them on bath nights when he was growing up. He left Coal Run, built on a former coal mine, in 1970 so his children wouldn't have to endure the same living conditions, he said.

"Today I feel that we are really blessed, to know and to see justice being met," Martin said. "And to see, regardless of who we are, there is a price to pay if you discriminate against people."

The plaintiffs' attorneys successfully argued that the decision not to pipe water to the plaintiffs was racially motivated, painting a picture of a community with a history of segregation. Black residents of Coal Run Road were denied water over the years while nearby white neighbors were provided it, they said.

Landes countered that about half of Muskingum County residents are not tied into the public water system even today. Among those without it are county commissioners, judges and other prominent officials, he said.

Zanesville has about 25,000 residents on the edge of the state's Appalachian region. One in every five families is below the federal poverty level, and the unemployment rate in Muskingum County in May was 7.4 percent. The national unemployment rate that month was 5.5 percent.
